breaking news out of oakland this morning where an erratic driver leads the chp on onfreeway chase. they say alcohol is involved. that driver is dead this morning and one on ramp still impacted on the freeway. i'm christie smith. we'll have that story coming up in a live report. it's so black you can barely see the sun. >> look at that, thick black smoke billowing over neighborhoods. a massive blaze at a plastics factory. potential hazards for those breathing it in. we'll have an update.

park turns1:y at thecc dangerous, a 13-year-old boy stabbed in the back while walking his dogs. how neighbors helped police cc1: track down the suspects. it's wednesday july 27th. this is "today in the bay." well, good morning, everyone. i'm scott mcgrew. it's 4:30. obviously a clear night out there. night, it's morning, or night, depending on your frame of reference. meteorologist christina loren. good morning. >> i'm under the impression a lot of people haven't gone to sleep yet who are waking up with us or joining us. looking good today, another mild day. see our temperatures about 5 to 10 degrees below seasonal averages once again. we're starting off with thick fog this morning, more than we had at this time yesterday. you do want to watch out for that. also expecting a major warm-up as we head through the next several days. i have the details. right now get to you work, 4:31

if that's where you're headed with mike inouye. >> a nice flow, typical overnight construction out of san francisco on that lower deck heading towards treasure island. also 880 northbound at market, still some construction work going on there. i'm going to call out this police activity on surface streets at the 29th avenue off-ramp. use the 23rd instead. why, one of our top stories so i'll hand it back to you. >> a high-speed chase ended dead lichlt the chase ended at 29th street at the exit of highway 880 and oakland. christie smith is there. good morning. >> reporter: good morning to you, scott. that pursuit ended here off 29th avenue northbound interstate 880 was the direction it was going. i want to show you the car involved here. it actually doesn't look like it's in that bad a shape this morning. chp telling us the driver was partially ejected from the car. they are also telling us that

alcohol was likely a factor here. the driver taken to highland hospital in oakland and pronounced dead this morning. here with me is officer sam morgan with the chp. good morning. can you was us through what happened here? this started or surface. >> international boulevard and 55th avenue our officers saw a driver weaving, driving erratically, attempted to stop the driver with an enforcement stop. the driver failed to yield. after a brief pursuit on surface streets, the driver entered 880 and attempted to exit at 29th avenue, did not negotiate the off-ramp and ended up colliding 29th avenue near east 9th. the driver was ejected from the vehicle. we did find signs of intoxication including open containers of alcohol. he was transported to the hospital where he succumbed to his injuries. do we know anything about this driver? why they would take off or who

they were. >> we have the identity. we're waiting for positive identity to be made by the coroner. we don't know why initially the suspect fled, if there were other mitigating circumstances or could be just the impairment of that particular individual, may have been other factors as well. so we'll be conducting a full investigation to determine what exactly transpired. real quickly, the off-ramp here of 29th avenue northbound still closed. do you know how much longer? >> it will be closed for probably the next couple of hours. we have our collision investigation teams on scene, which is standard protocol for chp when there's an officer-involved incident that leads to a death. >> thank you very much officer morgan for talking with us. that's the latest reporting live in oakland, christie smith, "today in the bay." this morning a 13-year-old boy is in the hospital after being stabbed in the back while walking his dog. police say the boy and a friend walking near erickson park in san jose, south part of san jose, that's when two other teenager boys came up and asked if they were part of a gang.

police say when the boys said new york city the two teens knocked one of them to the ground, stabbed that boy several times in the back. we spoke to a neighbor who tried to help the young man after the suspects ran away. >> he was down on the ground. he said oh, my gosh. i've been stabbed. am i going to die? >> she says another neighbor ran after the suspect for a few blocks and helped police catch a suspect. the boy who was stabbed recovering this morning. he should be released from the hospital in a few days. still no closure for an east bay family struggling with the disappearance of their daughter. tonight at 6:00 family and friends will gather at park in hayward to encourage people with information to come forward. the nursing student went missing at a shift at the hospital may 27th. le's family are hopeful she will

be found alive. police are investigating this case as a homicide. there's a $100,000 reward in that case. a fireball fueled by a load of plastic this morning. firefighters still dousing hot spots after a massive fire tore through a plastics factory near travis air force base in fairfield. firefighters say workers using an open flame in the storage area may have sparked that blaze. it burned for hours at macroplastics. thick plaque spewing over the factory and neighborhoods as far as 45 miles away. the fire is out but lots of people are still worried about the smoke. >> i had never seen a fire that was this black. so black you can barely see the sun. >> our main concern would be the type of irritant that it produces for somebody who may have asthma or who may be suffering from coughs or allergies. >> no one injured in the fire

but air quality experts, environmentalists as you heard are investigating what, if any toxins could come up because the plastic. voluntary evacuation orders in the area have been lifted. a car thief made off with more than a set of wheels when he bolted from a mcdonald's parking lot. he had some very pricey giants memorabilia as well. the man in the photograph, walnut creek say they caught him in action outside the mcdonald's on north california boulevard. the car's owner says he was inside getting a cup of coffee when he saw the thief hop into the car and take off on california boulevard. hidden in the back of the car, autographed bats and balls signed by giants legend hall of famer. the car a silver 2011 hyundai son atta, the license plate on the team. >> a sign of the times, bill

pay, paypal, the post office becoming much less relevant. the u.s. postmaster general says many will probably be shut down. thirteen of those are in the bay area, including this one in daly city. branches in san jose, oakland and san francisco are also on the list. no decision has been made yet. they will not be made until december. the postal service has lost $8 billion in one year. this morning an east bay animal shelter on the brink of closing. youtube video from the valley humane society in pleasanton. the shelter says it needs to raise $125,000 in the next 30 days or it might have to cut employees and programs, even close its doors. the nonprofit says the cost of food and supplies are up and donations are down. the financial problems come just after the shelter moved into a brand-new building on nevada street paid for through private donations. do to nature you can check valley humane.org.

let's check with christina loren and the morning forecast. >> hey, scott, how are you doing this morning? looking pretty good for a wednesday. trying to get over that hump is never easy but the weather today will make it a little bit easier for you especially if you're waking up with us in any of the inland cities across the bay area. we're going to see a really mild day compared to where we're headed. as we head into the weekend temperatures climbing in the 90s. 59 in hayward, 66 in sunnyvale, 60 san jose, because we're starting onso warm i bumped your daytime highs up by 5 degrees from yesterday. we are going to see a couple of low 90s but only in the warmer cities across the bay. outlaying airs fairfield and gilroy. st. francis 73, 85 for redwood city and 88 in los gatos. i've got that weekend forecast. after all, we're very, very close now. right now let's get you out that front door. if you're headed to work, let's see what's on the roads blocking your way.

>> construction, you know it gets worse instead of better. we have to fix the roads. thank goodness they are there. highway 17 at the bottom of the screen between mark and the summit some construction continues there, some slower drivers on the sensors because there's a restricted flow down to one lane in spots. watch that. top of the screen construction 101 at moffett. that should clear under 20 minutes. the same area christina is talking about jason al dean, country music star, saw him on country music awards with kelly clarkson, he'll be there. it's a soldout concert. be crowded, 101 around shoreline, a 7:00 concert but backups in the vicinity of moffett, shoreline and 85. watch for that. we still have the closure of 29th avenue, off-ramp from northbound side of 880, christie smith will continue to give us updates after that police activity continues there. a deadly crash after police pursued a lot of details there. use 23rd as the alternate,

market 880 construction there but that should be clearing over the next 45 minutes. 880 light volume. >> glad to have you this morning, mike. thank you very much. it is 4:40, an afternoon bike ride in napa a two-year ordeal for a cyclist that got tangled in a wire from dangling from a hot air balloon. the wire lifted her off her bike, slammed her into the pavement after the balloon was landing. nearly two years later she's recovering from three surgeries. a lawsuit she's demanding naapa valley balloons is responsible for the accident. she doesn't want to shut down the hot air balloon industry but wants to make sure nothing like this would happen again. >> they would put up signs warning people, stay back and wait. please get off your bike and walk around, whatever. that's one change. then i hope, you know, that i get better.

good morning. >> good morning, scott. futures are flat after stocks fell again yesterday as investors are starting to get a little bit worried about the lack of progress on capitol hill to solve the debt crisis. house republicans are delaying a vote on john boehner's bill because the congressional budget office says it will not save as much money as expected. markets lost ground because of disappointing earnings of 3m in the u.s. we get some data on durable goods and more earnings on boeing and conocophillips. dow fell, 12,501, nasdaq slipped two to 2839. do you want apples with that? mcdonald's taking steps to fend off regulation over what our kids can eat. the fast-food giant will put apple slices in happy meals and take out yummy caramel dipping sauce. if you missed "family guy"

soon. that's my faefrt part of the show. looking good, got low pressure sitting to the north yet again. the difference between yesterday and today is it's kind of drifted a little bit further to the north. that means we're not going to see as much of an on-shore flow this morning, hence, not as much fog and warmer afternoon even in san francisco. your weather significantly improving as we head through the next few days, less and low cloud cover to start. 66 degrees in sunnyvale. 88 degrees. that's the forecast and high in places like los gatos. when under the circumstances in your car in the heat of the day, we'll feel much warmer. you might turn on your ac in the car. probably won't need it, nice for the first part of the day. 89 in concord. meanwhile you're up to 73 degrees finally in san francisco. getting a taste of that summertime weather finally here at the end of july as we head throughout the weekend temperatures continue to climb up to about 95 degrees on

welcome back to you. it's 4:52 as we take a look at san jose and the pavilion there. a new marijuana bill trying to blaze the trail that prop 19 couldn't. the new measure would totally decriminalize marijuana sale, possession, cultivation, distribution for anyone 21 and up. but advertising pot, except for medical use, would still be

banned. the sponsors of the bill including former orange county supervisors judge have until december 19th to have enough signatures to put it to vote. oakland-based backers of prop 19 are not behind this bill but they plan to draft a new initiative of their own for the 2012 ballot. they will land alone for the new stadium without the raiders. the 49ers alone are eligible for a $100 million loan or more from the nfl. there had been talk of sharing the stadium with the raiders in order to secure that money. now $100 million is just a start. even if the team got the loan, they would still need to lock down hundreds of billions more to build their stadium in santa clara. lots more ahead this morning "today in the bay." let's check in with laura. good morning. >> good morning, scott. good morning, everyone. we're, of course, following the investigation this morning into a killing in oakland that appears to be related to a
